1. Agreement to Terms

By accessing or using Fundamentl, you agree to be bound by these Terms of Service and our Privacy Policy. These Terms apply to all users of our nonprofit operating platform.

2. Description of Service

Fundamentl provides nonprofit operating tools for grant discovery and management, donor records, campaigns, events, volunteers, board reporting, operations, workflow automation, AI-assisted writing, and post-award management.

3. Subscription and Payments

Subscription fees are shown on the pricing page and may vary by plan, billing term, and organization needs. Paid subscriptions are billed in advance. We offer a 14-day free trial. You may cancel anytime - cancellation takes effect at the end of your billing period. All fees are non-refundable except as required by law.

4. Acceptable Use

You agree NOT to:

• Use the Service for illegal purposes
• Share account credentials with unauthorized users
• Scrape or redistribute our foundation database
• Upload malware or malicious code
• Interfere with the Service or other users

5. SMS Messaging Terms

If you opt in to Fundamentl SMS, you may receive appointment reminders, program updates, schedule changes, cancellations, and related service notifications. Message frequency varies, up to 4 messages per month. Message and data rates may apply. Consent to SMS is not a condition of receiving services.

6. Intellectual Property

The Service and its content are owned by Fundamentl. You retain ownership of your grant proposals and documents. AI-generated content is provided for your review and editing.

8. Limitation of Liability

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES including lost grants, missed deadlines, data loss, or business interruption. Total liability is limited to fees paid in the prior 12 months or $100, whichever is greater.

9. Termination

You may cancel your account anytime. We may suspend or terminate accounts that violate these Terms, fail to pay, or pose security risks. Upon termination, you have 30 days to export your data.

10. Changes to These Terms

We may update these Terms with notice by email and in-app notification. Continued use after changes indicates acceptance.
